Purchase rules

To ensure the protection of your rights, please read carefully and familiarize yourself with the terms and conditions of sale and purchase rules (hereinafter the Rules).

    1. General provisions:
    1.1. This document is a purchase-sale agreement (hereinafter referred to as the Agreement) between UAB AURUM LT (hereinafter - the Seller) and the buyer (hereinafter - the Buyer), which determines the common rights, duties and responsibilities of acquiring the goods in the online shop operating with the NATIONAL GOLD BANK brand (hereinafter - the Shop).
    1.2. Before confirming your order, at the purchase step, "APPROVAL OF INFORMATION (step 3/4)", the buyer gets acquainted with the rules and confirms this by ticking "I agree with the site's rules". The Buyer is not given the opportunity to place an order if the Buyer is not familiar with the rules and has agreed to them.
    1.3. The Seller reserves the right to change, amend or supplement the Rules at any time in accordance with the legal requirements. In case the rules are changed according to the requirements of mandatory legal acts, the amended provisions of the rules of the parties shall apply from the moment of mandatory legal provisions coming into force. If the Rules are changed in accordance with the requirements of the dispositional legal acts, the Client shall be subject to the rules in force before the amendments.
    2. Protection of personal data:
    I. The Buyer agrees that UAB "AURUM LT" will process the data provided in this form, which is necessary to contact the buyer and register the order.
    II. Any information relating to personal data that is registered in the Store (name, address, telephone number, email address, and other information contained in the e-shop registration form) is collected for:
    ⦁ Process orders for goods or services.
    ⦁ Solve problems with delivery of goods.
    ⦁ To fulfill other contractual obligations.
     III.     In the event of the cancellation of the store, all collected user data is permanently               destroyed.
    3. Date of contract award:
    I. The Parties agree that a specific Goods Agreement shall be deemed concluded and shall come into force from the moment when the Seller sends an e-mail with a prepayment account to the Buyer at the e-mail address specified by the Seller. From this point on, the Buyer undertakes to pay the full amount by transferring the money to the Seller's account, the money must be credited to the Company account within 1 hour. (one hour).
    4. Buyer Rights:
    I. The Buyer has the right to purchase goods in the Shop in accordance with these Rules.
    II. The Buyer, if he is a consumer (concluding a contract with business, trade, craft or profession for non-consumer purposes), has the right to withdraw from the Agreement concluded with the Merchant by notifying the Seller of the return form no later than 14 (fourteen) days from the date of delivery of the item, unless the contract is for:
    ⦁ Gemstones, precious stones, precious metals and articles thereof, other than imitation jewelery;
    ⦁ Works of art, collectibles and antiques;
    ⦁ In other cases provided by law.
     III.     The Purchaser 's right (Rules 4.2. ) shall be exercised in accordance with the provisions   of the legislation in force.
     IV.  Purchaser may exercise the right to provide Rule 4.2.  only if the product has not been damaged or has substantially changed its appearance, has been fully preserved, including the packaging, and has not been used.
    5. Customer Responsibilities:
    I. The Buyer must pay for the goods and accept them in the manner prescribed by these Rules.
    II. The Buyer, using the Store, undertakes to respect and not violate the established norms of conduct and morality, to not violate the rights and legitimate interests of third parties and to not violate the laws of the Republic of Lithuania.
    III. The Buyer must provide complete and correct information about himself / herself in the registration form. If the Purchaser submits inaccurate, false or misleading data in the Order - Registration Form, the Seller shall have the right to cancel the Buyer 's registration and erase the data or restrict the Buyer' s access to the Electronic Store.
    IV. When ordering goods, the buyer undertakes to indicate the place of delivery or pick-up of the goods.
    V. The Buyer undertakes to accept the goods by himself or by ordering any other person who will accept the goods in the “Comments” at any online shop operating under the trademark of the NATIONAL GOLD BANK. Other people who will not be listed,  will not be recognized.
    6. Seller rights:
    I. If the Buyer attempts to undermine the stability and security of the NATIONAL GOLD BANK or violates its obligations, the Seller shall have the right to restrict or suspend the Buyer's access to the e-store or, in exceptional cases, to cancel the Buyer's registration without notice.
    II. The Seller may temporarily or permanently terminate any electronic store operating under the trademark of the NATIONAL AUCTION BANK without prior notice to the Buyer. The rights of the Buyer prior to the termination or suspension of the specified activities are not affected or restricted in any way.
    III. The Seller has the right without prior notice to the Buyer to cancel his order, if the Buyer, having chosen the method of payment provided the Rules 8.3.1., shall not pay for the goods within 1 (one) banking hour.
    IV. The seller is entitled to terminate the order in the event of an emergency:
    ⦁ Technical issues that have affected the Shop's performance, information about goods and their prices.
    ⦁ Lack of ordered goods in stock.
    ⦁ There are major changes in the global market, leading to major changes in gold and silver prices.
    V.  The Seller shall inform the Buyer about the termination of the order within 1 (one) business day. If the Buyer has already settled the order, the payment is returned to the buyer's account within 1 (one) business day from the date of the application for refund.
    VI. In case of uncertainty about the information provided in the order, the Seller shall contact the Buyer by the phone number specified in the order at the latest on the next business day from the day of placing the order. The Seller has the right to cancel the order without prior notice to the Buyer if the Seller fails to contact the Buyer within 3 (three) business days.
    7. Seller's obligations:
    I. The Seller undertakes to provide the Buyer with access to any of the Stores operating under the trademark of the NATIONAL GOLD BANK under the conditions specified in these Rules and the Shop.
    II. The Seller undertakes to respect the Customer's privacy right to the personal information it holds in the Shop Registration Form, except in the cases provided for in the laws of the Republic of Lithuania and the “Privacy Policy”.
    III. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer under the conditions specified in paragraph 9 of the Rules.
    IV. If the Seller is unable to deliver the goods ordered by the Buyer due to important circumstances, undertakes to offer a similar or as similar as possible product. If the Buyer refuses to accept a similar or similar product, the Seller undertakes to return the money paid to the Buyer within 3 (three) business days if the payment has already been made.
    8. Goods prices, payment order and terms:
    I. The prices of the goods in any store operating under the trademark of the NATIONAL GOLD BANK are expressed in euros with VAT, except for the cases when the goods are exempt from VAT.
    II. The Seller starts to place the goods order only after the Buyer pays for the goods, except when the Buyer chooses the method of payment for the goods - payment at the time of picking the goods (at the point of sale). In accordance with the payment instructions provided in the Shop and not later than within 1 (one) banking hour of the moment of conclusion of the contract of purchase and sale of goods, the Buyer shall pay to the Seller for the goods (except in cases when the Customer chooses the method of payment for the goods - payment at the time of picking goods). Payment shall be deemed to have been made when the entire amount is received and credited to the Seller's bank account.
    III. The buyer pays for the goods in one of the following ways:
                   Payment via the bank's electronic banking system. Responsibility for data security lies  with the bank in question, as all monetary operations are carried out in the bank's electronic banking system. In order to use this form of payment, the buyer must have signed an electronic banking agreement with the bank.
                  Cash payment - The buyer pays for the goods at the time of their withdrawal.
    IV.    Paying by the 8.3.1. the Buyer shall pay for the goods within 1 (one) hour from the                      moment of conclusion of the contract of purchase.
    9. Delivery of goods:
    I. The Seller uses the services provided by Lithuanian Post and LTexpress to deliver the goods.
    II. Delivery prices and terms of the goods are indicated on the page on delivery information.
    III. These terms do not apply in cases where the Seller does not have the required goods and the Buyer is informed about the lack of goods ordered by him. At the same time, the Buyer agrees that in exceptional cases delivery of goods may be delayed due to unforeseen circumstances beyond the Seller's control. In this case, the Seller undertakes to contact the Buyer immediately and agree on the delivery of the goods.
    IV. In all cases, the Seller shall be released from liability for the violation of the delivery terms if the goods are not delivered to the Buyer or delivered in time due to the Buyer's fault or due to circumstances of the Buyer, such as:
    The buyer provides the wrong address or other information needed to deliver the item (s).
    The Buyer is not present at the Delivery Place agreed upon by the courier.
    Other similar reasons leading to the principle of reasonableness are attributable to the Buyer's fault.
    10. Responsibility:
    I. The Buyer is fully responsible for the correctness of the data contained in the order - registration form. If the Buyer does not submit the order - the exact form of the registration form, the Seller is not responsible for the consequences arising therefrom.
    II. The Buyer is responsible for the actions performed using any e-shop operating under the trademark of the NATIONAL AUCTION BANK in the e-shop.
    III. The Buyer is responsible for transferring his / her login data to third parties. If any shop operating with the services provided by the NATIONAL AUCTION BANK is used by a third party who has logged in to the e-shop using the Buyer's login data, the Seller considers this person to be the Buyer.
    IV. The Seller shall be exempt from any liability in cases where the loss arises from the fact that the Buyer, irrespective of the Seller's recommendations and his obligations, has not become acquainted with these Rules, even though such possibility has been granted to him.
    V. If any store operating under the trademark of the NATIONAL AUCTION BANK in the e-shop has links to the websites of other companies, institutions, organizations or persons, the Seller is not responsible for the information or activities carried out there, does not supervise, control or represent these companies and persons.
    VI. In case of damage, the guilty party compensates the other party for direct losses.
    11. Exchange of information:
    I. The Seller sends all messages to the e-mail address provided in the Buyer's registration form.
    II. The Buyer shall send all notices and inquiries to the Seller Shop in the means of communication indicated in the "Contacts" section.
    12. Final Provisions:
    I. These rules are based on the laws of the Republic of Lithuania.
    II. The law arising from these rules is governed by the law of the Republic of Lithuania.
    III. All disagreements arising from the implementation of these rules shall be resolved by negotiation. In case of failure to reach an agreement, disputes shall be settled in the manner prescribed by the laws of the Republic of Lithuania.
